BOROUGH OF STONE HARBOR <br>CAPE  BOROUGH OF STONE HARBOR  CAPE MAY COUNTY  ORDINANCE NO. 1688  AN ORDINANCE AMENDING CHAPTER 10, SECTIONS 10-37, 10-41; 10-46.1; AND 10-46.2; CHAPTER 156, SECTION 156.5; AND CHAPTER 18, SECTIONS 18-1, 18-2  OF THE BOROUGH OF STONE HARBOR MUNICIPAL CODE  BE IT ORDAINED by the Mayor and Council of the Borough of Stone Harbor, that Part I, Chapter 10, Sections 10-37; 10-41;  10-46.1; and 10-46.2, Chapter 156, Section 156.5; and Chapter 18, Sections 18-1, 18-2 of the Ordinances of the Borough of Stone  Harbor are hereby repealed in their entirety and shall now be amended and read as set forth below.  NOW THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Stone Harbor, Cape May County, New  Jersey, as follows:  Part I, Chapter 10, Sections 10-37; 10-41; 10-46.1; and 10-46.2 of the Ordinances of the Borough of Stone Harbor are hereby amended and revised repealed in their entirety and shall now be amended and read as follows:     10-37: Department established; composition  A.  The Police Department of the Borough of Stone Harbor is hereby established. This Department shall consist of a police force  and such other nonsworn or civilian personnel as the governing body of the Borough of Stone Harbor shall appoint. The police force  shall consist of one Chief of Police, one (1) Captain, one (1) Detective Sergeant, one Sergeant for each of the four (4) patrol squads  and ten (10) officers. Each patrol squad shall consist of a Sergeant and two (2) patrol officers; however, two patrol officers are not  mandated as the patrol squad is at the discretion of the Chief of Police. The remaining two (2) officers, the Chief of Police may assign  one (1) as a detective/patrol officer and one (1) as a SAS/patrol officer who acts as a rover, for the purpose of covering open shifts  due to leave time and/or other situations that cause an open patrol slot. These shall constitute the permanent sixteen (16) full-time  members of the police force, not including the Chief.  The police force may also consist of such temporary and special police officers as may from time to time be required on a seasonal  or emergency basis. Such employees shall carry out and obey all orders and instructions of the Chief of Police or, in his/her absence,  his/her designee. In the event of an officer in any of these positions being on leave, immediately preceding an announced retirement  or a suspension with intent to dismiss, the governing body may, for the efficiency of the Department, appoint a replacement to serve  in the vacant position. The governing body may also choose to leave a position vacant to undertake a review of whether the current  table of organization is still beneficial to the police mission. The governing body shall have up to one year from the effective date  of retirement or resignation to appoint/promote the replacement in order to conduct a thorough, fair and competitive search and  selection process. The salary, contractual compensation or other monies paid to members of the police force for their services shall  be provided by ordinance.  B.  The governing body may decrease the police force for reasons of economy. In accordance with N.J.S.A. 40A:14-143, the  governing body, if it shall deem it necessary for reasons of economy, may decrease the number of members and officers of the Police  Department or force or their grades or ranks.  C.  There shall also be such clerical, secretarial and administrative employees as the governing body shall appoint. Said members  shall not be members of the Police Department within the meaning of any provision of Chapter 14, Title 40A, of the Revised Statutes  of New Jersey, as amended and supplemented. Such employees shall carry out and obey all orders and instructions of the Chief of  Police or, in his/her absence, his/her designee.     10-41: Lieutenant of Police - Remove and Replace with     10-41: Captain of Police  The Captain shall report to the Chief of Police as will the Detective Sergeant. All Patrol Sergeants will report to the Captain. In  the absence of the Chief of Police, the Chief shall designate the Captain to assume the duties and responsibilities of the Chief. The  Captain shall conform to the duties imposed by the job description for Chief of Police as contained in adopted Borough policies, as  well as his/her duties as Captain.     10-46.1: Detective/Special Assignment Officer  A.  The Police Department shall have one (1) patrol officer designated as a detective in additional to their role as a patrol  officer and one (1) patrol officer may be designated as SAS (   special assignment officer   ) in addition to their role as a patrol officer.  These officers will be assigned, at the discretion of the Chief, to perform duties as a detective or special assignment officers.  B.  The Police Department may have one full-time temporary detective who shall be assigned by resolution to serve in  that position for a period not to exceed one year.  C.  The position of temporary detective shall be filled by an existing member of the Police Department at the time the  temporary assignment is made.  D.  The Chief of Police shall designate and assign the officer who shall serve in the position of temporary detective.  E.  The assignment of an officer to the position of temporary detective in one year shall not entitle that officer to fill the  position in any succeeding year but shall not preclude same.     10-46.2: Line of Authority.  A.  The following line of authority shall exist within the Police Department:  		  (1) Chief of Police.  		  (2) Captain  		  (3) Sergeant.  		  (4) Officer.  		  (5) Special Officer.  B.  Each rank/position shall be subordinate to all higher ranks as illustrated above.  C.  Civilian employees shall report to their assigned supervisor or designee.  II.  Part I, Chapter 156, SECTION 156-5 of the Ordinances of the Borough of Stone Harbor are hereby repealed in their  entirety and shall now be amended and read as follows:  The Mayor and Council are hereby authorized and empowered to :  A.  Adopt by resolution, in addition to the rules and regulations herein enumerated, such other rules and regulations as  may be necessary for the proper control and regulation of the beachfront and the waters adjacent thereto.  B.  Designate by resolution the protected bathing beaches where boats and lifeguards are to be provided by the Borough  and from which beaches persons may bathe and swim, and to change or abolish the precise location of any one or more of such  protected bathing beaches from time to time, as safety and attending circumstances shall require.  C.  Employ inspectors, lifeguards, and such other employees as may be necessary to carry out and enforce the provisions  of this section and all rules and regulations established herein or subsequently adopted by resolution.  D.  Purchase badges, checks or other insignia and such other supplies, materials and equipment as may be necessary.  E.  Designate by resolution of the Borough Council from time to time, upon written application therefor, that the requirements of having a beach badge be lifted on certain beaches for the duration of certain functions found by Borough Council to be in  the best interests of the Borough of Stone Harbor. Examples of such functions would be the conduct of a Hobie cat race, a sailing race,  a surfing tournament, a surf fishing tournament, or some other similar event. It is the intention of Borough Council that such events  be kept to a reasonable number so as not to unduly interfere with the public   s use of our beaches. There shall be a Beach Supervisor  appointed by the Mayor with the advice and consent of the Council, who shall serve for a term of up to one year, until the organization  meeting of Borough Council in January of the following year.  F.  Notwithstanding the above, the Governing Body hereby establishes that Beach operations shall function as a division  within the Department of Police (Public Safety).  III.  Part I, Chapter 18, Sections 18-1 and 18-2 of the Ordinances of the Borough of Stone Harbor are hereby repealed in  their entirety and shall now be amended and read as follows:  There shall be a Beach Supervisor appointed by the Mayor with the advice and consent of the Council, who shall serve for a term of  up to one year, and thereafter until a qualified successor is appointed     18-1 Beach Supervisor  A.  The Beach Supervisor, in coordination with the Chief of Police pursuant to Section 156, shall have the following responsibilities:  1.  Maintenance of beaches during the summer season.  2.  Enforcement of the beach fee program.  3.  Enforcement of beach rules and regulations except those delegated to the Lifeguard Patrol.  4.  Authority to employ such persons as are necessary to perform the functions described above, subject to the approval  as to the number of such persons by Borough Council.  5.  Authority to, from time to time, request the Captain and the lieutenants of the Lifeguard Patrol to assist in the supervision of beach maintenance employees and beach tag inspectors.  B.  All employees hired by the Beach Supervisor shall be seasonal temporary employees.     18-2 Lifeguard Patrol; Lifeguard Captain.  There shall be a Lifeguard Patrol consisting of a Captain, together with such lieutenants and other officers and personnel as may be  required.  A.  There shall be a Lifeguard Captain appointed by the Mayor, with the advice and consent of the Council, who shall serve as a  seasonal officer for a term of up to one year and thereafter until a qualified successor is appointed  1.  The Captain shall have the following responsibilities:  a.  The protection of all the beaches.  b.  The development of a Beach Patrol Operations Manual.  c.  In consultation and cooperation with the Chief of Police, enforcement of all beach rules and regulations, pertaining to  bathing, boating, fishing, sunning, and recreation.  d.  Authority to employ such persons as are necessary to patrol and protect the beaches, subject to the approval as to the  number of such persons by Borough Council.  e.  All employees hired by the Lifeguard Captain, pursuant to policies, procedures and directives approved by the Governing Body and administered through the Business Administration and the Human Resources Officer shall be seasonal employees.  f.  The Lifeguard Patrol Captain and the Lifeguard Patrol lieutenants shall, from time to time, upon the request of the  Beach Supervisor, assist the Beach Supervisor in the supervision of beach maintenance employees and beach tag inspectors. There  shall be a Beach Tag Supervisor appointed by the Mayor, with the advice and consent of the Council, who shall serve as a seasonal  officer.  2.    gram.    The Beach Tag Supervisor shall have the following responsibilities:  a.  As recommended by the CFO and approved by the Governing Body, organization of the beach fee program.  b.  As approved by the Governing Body, enforcement of the beach fee program.  c.  As established by and under direction of the CFO, enforcement of the Borough   s accounting practices for the pro-    d.  Pursuant to policies, procedures and directives approved by the Governing Body and administered through the Business Administration and the Human Resources Officer, authority to employ such persons as are necessary to sell beach tags and  enforce the use of tags, subject to the approval as to the number of such persons by Borough Council.  3.    All employees hired by the Beach Tag Supervisor shall be seasonal employees.    SEVERABILITY  If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by  any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding  shall not affect the validity of the remaining portions thereof.  EFFECTIVE DATE  This ordinance shall take effect upon passage and publication as provided by law. CITY OF WILDWOOD Cape May County, New Jersey RESOLUTION A RESOLUTION AMENDING A CONTRACT WITH REMINGTON & VERNICK ENGINEERS FOR ADDITIONAL CONSTRUCTION PHASE SERVICES FOR SUSQUEHANNA AVENUE DRAINAGE IMPROVEMENTS WHEREAS, in connection with the Ottens Harbor Flood Mitigation Project Susquehanna Avenue Drainage Improvements (the Project), a water main leak was identified and it was determined that the same was in need of replacement; and WHEREAS, additional engineering services beyond the scope of the original contract awarded contract to Remington & Vernick Engineers (RVE), the Project Engineer, was required to properly complete the work; and WHEREAS, RVE has submitted an invoice for the additional construction phase services provided in the amount of Five Thousand Eight Hundred ($5,800.00) Dollars; and WHEREAS, the City of Wildwood Chief Financial Officer (CFO) has certified that there are sufficient funds to pay for the contract of the above referenced vendor. NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the City of Wildwood, Cape May County, State of New Jersey, that the contract with RVE in connection with the Ottens Harbor Flood Mitigation Project Susquehanna Avenue Drainage Improvements is hereby amended to include an increase in the amount of $5,800 and that the Mayor and City Clerk are hereby authorized and directed to execute any documents as may be necessary to effectuate the same. CITY OF WILDWOOD Cape May County, New Jersey RESOLUTION AUTHORIZING THE EXECUTION OF CHANGE ORDER NO. 3 FOR FRED M. SCHIAVONE CONSTRUCTION, INC. IN THE INCREASED AMOUNT OF $21,773.48 IN CONNECTION WITH BOARDWALK REHABILITATION PHASE VI WHEREAS, the City of Wildwood contracted with Fred M. Schiavone Construction, Inc. (hereinafter Contractor) pursuant to Resolution No. 348-8-24 for services associated with the Boardwalk Rehabilitation Project Phase VI and VII (hereinafter Project), the material provisions of which are incorporated by reference herein; and WHEREAS, the Project Engineer for the City, Colliers Engineering & Design, has recommended Change Order No. 3 for the Project; and WHEREAS, Change Order No. 3 recommends a contract increase in the amount of Twenty-One Thousand Seven Hundred Seventy-Three and 48/100 ($21,773.48) Dollars to account for temporary lighting and the installation of additional speaker mounts and hardware in connection with the Project; and WHEREAS, the original amount of the contract was $4,173,387.01, subsequently modified by Change Orders No. 1 and 2, and this Change Order No. 3 increases the contract to $4,944,884.42 representing an overall increase of 18.486% from the original amount; and WHEREAS, the Chief Financial Officer for the City of Wildwood has certified as to the availability of funds; and WHEREAS, the revisions to the contract and this Change Order are necessary in order to complete the project in the most efficient and cost-effective manner for residents of the City of Wildwood. NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Wildwood, County of Cape May, State of New Jersey as follows: 1.That the provisions of the above preamble of this Resolution are hereby incorporated herein, by this reference, as if set forth at length. 2.That the Contractors contract is hereby modified and amended to reflect the substantive portions of this Change Order No. 3 and to include an increase in the amount of $21,773.48. 3.That all appropriate municipal officials of the City of Wildwood are hereby authorized, empowered, and directed to undertake the necessary actions to further the execution of said Change Order No. 3. 4.That notice of this Resolution shall be published according to law. CITY OF WILDWOOD Cape May County, New Jersey RESOLUTION RESOLUTION AUTHORIZING TRIAD ASSOCIATES TO PREPARE AND PROCESS A 2025 USDOT SAFE STREETS AND ROADS FOR ALL (SS4A) PLANNING GRANT PROGRAM APPLICATION WHEREAS, grant opportunities are available to the City of Wildwood (the City) through the 2025 USDOT Safe Streets and Roads for All (SS4A) Planning Gran Program Application; and WHEREAS, the City has received a proposal from Triad Associates (Triad) to prepare and process the 2025 USDOT Safe Streets and Roads For All (SS4A) Planning Grant Program Application as authorized under the existing Professional Services Agreement (2025 General Services Agreement) in the amount not to exceed $5,250.00; and WHEREAS, the City has reviewed the proposal and wishes to authorize Triad to perform the grant consulting services described therein, the terms of which are incorporated herein by reference; and WHEREAS, the Chief Financial Officer has certified to the availability of funds for same as the services herein fall within the existing scope of work and funds are available through the Citys existing contract with Triad. NEW JERSEY TRANSIT CORPORATION <br>FEDERAL  NEW JERSEY TRANSIT CORPORATION  FEDERAL FISCAL YEAR 2024 REQUEST FOR FEDERAL FINANCIAL ASSISTANCE  The New Jersey Transit Corporation (NJ TRANSIT), under the Infrastructure Investment and Jobs Act, (IIJA),  Fixing America   s Surface Transportation (FAST) Act, and under provisions of Moving Ahead for Progress in the  21st Century (MAP-21), gives notice of its intent to apply for Federal Fiscal Year 2024 federal financial  assistance, Federal Fiscal Year 2023, Federal Fiscal Year 2022 and Federal Fiscal Year 2021 carryover funds  from the following programs: $893.587 million under 49 U.S.C. Section 5307 for operating and capital  assistance; $115.800 million under Section 5337 State of Good Repair; $19.596 million under Section 5339  Bus and Bus Facilities; $16.747 million under 49 U.S.C. Sections 5310 Enhanced Mobility of Seniors and  Individuals with Disabilities and Section 5311 Rural Transportation Program; $25.024 million as part of a  Section 5309 Full Funding Grant Agreement (FFGA); $329.817 million of Federal Highway Administration  Flexible Funds; $29.860 million of discretionary or competitive funding for a total of $1.430 billion.  Federal operating assistance for Local Programs will be matched as required with funds provided by the State  of New Jersey and local recipients in conformance with Federal and State guidelines. NJ TRANSIT intends to  provide the non-Federal share of capital projects with transportation development credits, or funding available  from the Transportation Trust Fund and other eligible sources. The Federal Fiscal Year 2024 Federal program  is described below. A.Between May 15 and September 30; annually, street openings and excavation work is permitted only on Tuesday through Thursday. No street openings or excavation work is permitted on Friday through Monday during this time period, unless approved by the Borough Engineer and Construction Official. B.A. The applicant to whom such permit is issued shall, within the time limited in such permit, replace the earth and pavement in the excavation in such manner that the same shall be left in as good condition as it was before the excavation was commenced. Except as otherwise herein stated, all street work performed shall be in accordance with the applicable provisions of the New Jersey Department of Transportation (NJDOT) Standard Specifications for Road and Bridge Construction, including all amendments. (1)Building Volume or Cost. Fees for new construction shall be based upon the volume of the structure. Volume shall be computed in accordance with N.J.A.C. 5:23-2.28. Section 4.If any portion of this ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this ordinance, but shall be confined in its effect to the provision directly involved in the controversy in which such judgment shall have been rendered.
