NOTICE OF PENDING ORDINANCE Notice is hereby given that the following ordinance was introduced at a meeting of the Board of Commissioners of the Borough of Wildwood Crest on May 27, 2025 and passed on first reading, and the same was then ordered to be published according to law; and that such ordinance will be further considered for final passage at a meeting of the Board of Commissioners to be held at the Borough Hall in said Borough on June 11, 2025 at 9:30 A.M. prevailing time, or as soon thereafter as possible, at which time and place all persons interested will be given an opportunity to be heard concerning such ordinance. BOROUGH OF WILDWOOD CREST COUNTY OF CAPE MAY NEW JERSEY ORDINANCE NO. 1458 ORDINANCE OF THE BOROUGH OF WILDWOOD CREST AMENDING AND SUPPLEMENTING THE CODE OF THE BOROUGH OF WILDWOOD CREST CHAPTER 67, UNIFORM CONSTRUCTION CODE, SECTION 67-4 RESTORATION OF EXCAVATED AREA WHEREAS, the Board of Commissioners of the Borough of Wildwood Crest for good government, order and the protection of persons and property, and for the preservation of the public health, safety and welfare of the Borough and its inhabitants, desires to supplement and amend the Code of the Borough of Wildwood Crest to adjust the dates and days for street openings. NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the Borough of Wildwood Crest in the County of Cape May and State of New Jersey, as follows: (new language is underlined, removed language is stricken): Section 1.Ordinance No. 473, adopted December 20, 1974, Ordinance No. 480, adopted April 23, 1975, Ordinance No. 530, adopted October 17, 1978, Ordinance No. 683, adopted December 5, 1988, Ordinance No. 935, adopted June 25, 2003, Ordinance No. 973, adopted March 9, 2005, Ordinance No. 984, adopted October 26,2005, Ordinance No. 1197 adopted November 5, 2015, Ordinance No. 1243, adopted August 10, 2016 and Ordinance No. 1245, adopted November 30, 2016, and Ordinance 1428 adopted April 9, 2024 that has been codified as Chapter 67, entitled Street Excavations, of the Code of the Borough of Wildwood Crest is hereby amended and supplemented as follows: Chapter 67 STREET OPENINGS AND EXCAVATIONS 67-4 Opening; Rrestoration of excavated area. A.Between May 15 and September 30; annually, street openings and excavation work is permitted only on Tuesday through Thursday. No street openings or excavation work is permitted on Friday through Monday during this time period, unless approved by the Borough Engineer and Construction Official. B.A. The applicant to whom such permit is issued shall, within the time limited in such permit, replace the earth and pavement in the excavation in such manner that the same shall be left in as good condition as it was before the excavation was commenced. Except as otherwise herein stated, all street work performed shall be in accordance with the applicable provisions of the New Jersey Department of Transportation (NJDOT) Standard Specifications for Road and Bridge Construction, including all amendments. Reference to articles or sections hereinafter refer to said NJDOT standard specifications. Section 2.Paragraph 67-4(B) shall be retitled paragraph (C). Section 3.The remainder of all other sections and subsections of the aforementioned ordinance not specifically amended by this Ordinance shall remain in full force and effect. Section 4.All other ordinances in conflict with or inconsistent with this ordinance are hereby repealed to the extent of such inconsistency. Section 6.If any portion of this ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this ordinance, but shall be confined in its effect to the provision directly involved in the controversy in which such judgment shall have been rendered.
