REQUEST FOR RELEASE OF FUNDS On or about July 18, 2025, the City of North Wildwood (City) will submit a request to the NJ Department of Community Affairs (NJDCA) for the release of Community Development Block Grant (CDBG) funds to undertake the following project, pursuant to 24 CFR Part 58, Section 58.36: Removal of Architectural Barriers to Accessibility FY 2025 CDBG funding of $400,000 for the construction of an Americans with Disabilities Act (ADA)-compliant access ramp, stairs and other related work Project location: East 18th Avenue and the Boardwalk, North Wildwood, NJ Total estimated project cost: $796,848 The proposed improvements to safely access the Boardwalk at 18th Avenue include demolition of the existing ramp within the active street, restoration of the roadway where disturbed; construction of fully ADA compliant access under the boardwalk to the existing ADA-compliant, at-grade bicycle/pedestrian path on the beach, construction of a new fully ADA-compliant access ramp on the beach between the compliant at-grade path and the Boardwalk and the construction of ADA-compliant steps. The project is expected to be completed by November 2026. FINDING OF NO SIGNIFICANT IMPACT The City has determined that the above project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. REQUEST FOR RELEASE OF FUNDS On or about July 18, 2025, the City of North Wildwood (City) will submit a request to the NJ Department of Community Affairs (NJDCA) for the release of Community Development Block Grant (CDBG) funds to undertake the following project, pursuant to 24 CFR Part 58, Section 58.36: Removal of Architectural Barriers to Accessibility FY 2025 CDBG funding of $400,000 for the construction of an Americans with Disabilities Act (ADA)-compliant access ramp, stairs and other related work Project location: East 18th Avenue and the Boardwalk, North Wildwood, NJ Total estimated project cost: $796,848 The proposed improvements to safely access the Boardwalk at 18th Avenue include demolition of the existing ramp within the active street, restoration of the roadway where disturbed; construction of fully ADA compliant access under the boardwalk to the existing ADA-compliant, at-grade bicycle/pedestrian path on the beach, construction of a new fully ADA-compliant access ramp on the beach between the compliant at-grade path and the Boardwalk and the construction of ADA-compliant steps. TO SERVE AS CONFLICT TAX COUNSEL WHEREAS, a property owner in the City of Wildwood (the City) has filed a tax appeal against the City seeking a reduction in the assessed value of the property; and WHEREAS, the Citys current tax appeal counsel has a conflict of interest with the subject property owner and cannot represent the Citys interest given the rules governing the practice of law; and WHEREAS, the City is therefore in need of a Conflict Tax Counsel and The DeWeese Law Firm, P.C. has submitted a proposal to the City to serve as Conflict Tax Counsel; and WHEREAS, the Board of Commissioners has reviewed the same and wishes to enter into an agreement with The DeWeese Law Firm, P.C. for part-time Conflict Tax Counsel services as a non-fair and open contract pursuant to Pay to Play laws, N.J.S.A. 19:44A-20.4 et seq; and WHEREAS, The DeWeese Law Firm, P.C. has completed and submitted a Business Entity Disclosure Certification which certifies that said entity has not made any reportable contributions to a political or candidate committee in the City of Wildwood in the previous one year, and that the contract will prohibit it from making any reportable contributions for the term of the contract; and WHEREAS, the Local Public Contract Law N.J.S.A. 40A:11-1, et seq. permits for the adoption of a resolution authorizing the award of a contract for professional services without competitive bids; and WHEREAS, the Chief Financial Officer of the City of Wildwood has certified the availability of funds. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Wildwood, County of Cape May, State of New Jersey as follows: 1.That the provisions of the above preamble of this Resolution are hereby incorporated by reference as if set forth at length. 2.That the Board of Commissioners hereby approves a professional services agreement with The DeWeese Law Firm, P.C., 3200 Pacific Ave, Wildwood, NJ 08260 as more specifically set forth in the proposal annexed hereto and incorporated by reference herein, to serve as conflict tax counsel in an amount not to exceed Five Thousand ($5,000.00) Dollars. 3.The Mayor and City Clerk are hereby authorized and directed to execute the contract on behalf of the City, and to take any and all other actions necessary to effectuate the purposes thereof. 4.The Business Disclosure Entity Certification and a copy of the agreement shall be placed on the file with this Resolution. 5.That this Resolution shall be published according to law.
