BOROUGH OF AVAON CAPE MAY COUNTY, NEW JERSEY BAY PARK MARINA LIVING SHORELINE IMPROVEMENTS CONTRACT NO. M-143 NOTICE TO BIDDERS NOTICE is hereby given that sealed bids will be received by the Borough of Avalon (hereinafter called the Owner) for: BAY PARK MARINA LIVING SHORELINE IMPROVEMENTS CONTRACT NO. M-143 Sealed bids for the above named Contract, which comprises the construction of living shoreline improvements, within the Borough of Avalon, Cape May County, New Jersey (Owner), will be received by the Borough Treasurer, Borough Hall, 3100 Dune Drive, Avalon, New Jersey 08202 on Wednesday, August 27, 2025 at 2:00 p.m. prevailing time, at which time they will be publicly unsealed and the contents publicly announced. The work includes the furnishing of all labor, materials and equipment necessary to complete the work as shown on the Drawings and as described in the Specifications. The work consists of the demolition of existing site features and construction of a living shoreline inclusive of marine mattress, soil, plantings, oyster castles, coir logs,and site restoration. The work is generally located waterward of the newly constructed Bay Park Marina bulkhead and flood wall, starting just south of the new boat ramp and extending south to just north of the 57th Street beach. All work shall be conducted in accordance with the State and Federal permits and as described in the contract specifications or as shown on the drawings. The work shall be completed within 210 calendar days of the Contractors receipt of written Notice to Proceed. No bid will be received unless in writing on the forms furnished, and unless accompanied by bid security in the form of a bid bond, cashiers check, or a certified check made payable to the Borough of Avalon in an amount equal to 10% of the amount of the total bid, but not exceeding $20,000. The bid shall be accompanied by a Certificate of Surety on the form included in the Contract Docu-ments, from a surety company licensed to do business in the State of New Jersey, which shall represent that the surety company will provide the Contractor with the required bonds in the sums required in the Contract Documents and in a form satisfactory to the Owners Attorney and in compliance with the requirements of law. Bidders must use the prepared bid form which is contained in the Contract Documents. All Bid Proposals shall be either mailed or dropped off in person at the Borough Hall, 3100 Dune Drive, Avalon, NJ 08202 in a sealed envelope with the bidders name and address and clearly marked on the outside of envelope with the contract name, number and the name and address of the bidder that is submitting the proposal. Attendance at the Pre-Bid Conference is not mandatory; however, Contractors are strongly encouraged to attend. The Owner shall award the Contract or reject all bids within 60 days of bid opening, except that the bids of any bidders who consent thereto may, at the request of the Owner, be held for consideration for such longer period as may be agreed. Should the bidder not be the actual owner or leasee of such equipment, his certificate shall state the source from which the equipment will be obtained and, in addition, shall be accompanied by a signed certificate from the owner or person in control of the equipment definitely granting to the bidder the control of the equipment required during such time as may be necessary for the completion of that portion of the Contract for which it is necessary. The bidder shall comply with the documentation requirements set forth in the Article of the Information for Bidders, entitled, Bidder Submissions. The successful bidder will be required to submit bonds and proof of insurance on or before execution of their respective Contracts as explained in the Contract Documents. Pursuant to N.J.S.A. 10:5-31 et seq., bidders are required to comply with the requirements of N.J.A.C. 17:27. Each Bidder must submit with his bid an Ownership Disclosure Statement and is requested to submit with his bid the Non-Collusion Affidavit on the forms included in the Contract Documents. Bidders and their subcontractors of any tier must comply with all applicable provisions of the Public Works Contractor Registration Act (N.J.S.A. 34:11-56.48) and the New Jersey Prevailing Wage Act (N.J.S.A. 34:11-56.25). P.L. 2021, c. 301 requires that if a Contract is subject to the Prevailing Wage Act and the contractor submitting the lowest bid for a Contract is 10 percent (or more) lower than the next lowest bid, the bidder must certify to the public body that the prevailing wage rates required by the Act shall be paid. If the Bidder does not provide the certification prior to the award of the contract, the public body will award the Contract to the next lowest responsible and responsive Bidder. Further, P.L. 2021, c. 301 also amended N.J.S.A. 34:11-56.27 to require that any Contract for public work expressly stipulate that workers performing work under the contract shall not be paid less than the required prevailing wage rate. Contractors and their sureties shall be liable to the public body, any lessee to whom the public body is leasing a property or premises or to any lessor from whom the public body is leasing or will be leasing a property or premises, for any excess costs occasioned by the termination of their right to proceed with the work, or such part of the work as to which there has been a failure to pay required wages. Pursuant to N.J.S.A. 52:32-44, all business organizations that conduct business with a New Jersey government agency are required to be registered with the State of New Jersey. Bidders and their subcontractors must submit proof that they are registered with the New Jersey Department of Treasury, Division of Revenue by submitting a copy of their Business Registration Certificate prior to Contract award. CITY OF WILDWOOD Cape May County, New Jersey RESOLUTION A RESOLUTION AUTHORIZING A CONTRACT FOR ACTUARIAL SERVICES FOR THE CITY OF WILDWOOD BEACH PATROL PENSION PLAN WHEREAS, the City of Wildwood (the City) has need for actuarial services with regards to its Beach Patrol Pension Plan Actuarial Valuation; and WHEREAS, RAE Group, LLC (hereinafter RAE) has submitted a proposal to the City outlining the scope of work necessary to perform the project, annexed hereto and incorporated by reference herein, in an amount not to exceed Twelve Thousand ($12,000.00) Dollars; and WHEREAS, the Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(a)(i), provides for the award of professional services without engaging in the bidding process to a person(s) authorized by law to practice a recognized profession; and WHEREAS, the City has reviewed the proposal and determined to award a professional services contract to RAE for the services outlined therein as a non-fair and open contract pursuant to Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.; and WHEREAS, RAE has completed and submitted a Business Entity Disclosure Certification which certifies that said entity has not made any reportable contributions to a political or candidate committee in the City of Wildwood in the previous one year, and that the contract will prohibit it from making any reportable contributions for the term of the contract; and WHEREAS, the City CFO has certified as to the availability of funds. TO PROVIDE TOPSOIL FOR THE BACK BAY LANDFILL CLOSURE WHEREAS, the City of Wildwood (the City) is currently engaged in the closure of the former landfill and development of the former Department of Public Works site as part of the Back Bay Redevelopment Area Project (the Project); and WHEREAS, the City, in accordance with the New Jersey Local Public Contracts Law, advertised for bids to provide the City with topsoil for the Project (hereinafter the Contract) on June 4, 2025 pursuant to Resolution No. 224-5-25; and WHEREAS, the City received no submissions and subsequently readvertised the Contract as authorized by Resolution 262-6-25 passed at the June 25, 2025 Board of Commissioners meeting; and WHEREAS, the City received one (1) bid in connection with the second advertisement of the Contract when bids were opened on July 17, 2025 from Tuckahoe Sand & Gravel Company, Inc.; and WHEREAS, the bid has been reviewed by the City and it has been determined that Tuckahoe Sand & Gravel Company, Inc. submitted the lowest responsible bid, annexed hereto and incorporated by reference herein, for the services to be provided under the Contract in the amount of Three Hundred Eighty-Nine Thousand Five Hundred ($389,500.00) Dollars; and WHEREAS, the Chief Financial Officer of the City of Wildwood has certified the availability of funds; and WHEREAS, the City wishes to award the Contract to Tuckahoe Sand & Gravel Company, Inc. as set forth herein. CITY OF WILDWOOD Cape May County, New Jersey RESOLUTION A RESOLUTION AUTHORIZING THE AWARD OF A LEASE OF EQUIPMENT SPACE TO CELLCO PARTNERSHIP D/B/A VERIZON WIRELESS WHEREAS, the City of Wildwood (the City) owns real property located at the intersection of 6th Avenue and New Jersey Avenue in North Wildwood, Block 215, Lot 1, where a water tank operated by the Wildwood Water Utility is located; and WHEREAS, the City, in accordance with the New Jersey Local Public Contracts Law (LCPL), advertised for bids for the Lease of Equipment Space (hereinafter the Lease) pursuant to Resolution No. 227-5-25; and WHEREAS, the City received one (1) bid in connection with the advertisement of the Lease when bids were opened on July 10, 2025 from Cellco Partnership d/b/a Verizon Wireless; and WHEREAS, the bid has been reviewed by the City and it has been determined that Cellco Partnership d/b/a Verizon Wireless submitted the highest responsible bid, annexed hereto and incorporated by reference herein; and WHEREAS, the City wishes to award the Lease to Cellco Partnership d/b/a Verizon Wireless as set forth herein. CITY OF WILDWOOD PLANNING/ZONING BOARD NOTICE OF APPLICATION PLEASE TAKE NOTICE that Honest Builds LLC (the Applicant), has applied to the Planning/Zoning Board of the City of Wildwood, Cape May County, New Jersey seeking minor subdivision approval, preliminary and final major site plan approval, and variance relief respecting the property that it owns, which is located at 3800 Park Boulevard, Wildwood, New Jersey 08260 (Block 152, Lot 13). CITY OF WILDWOOD Cape May County, New Jersey RESOLUTION A RESOLUTION AUTHORIZING THE AWARD OF A CONTRACT TO TUCKAHOE SAND & GRAVEL COMPANY, INC. TO PROVIDE TOPSOIL FOR THE BACK BAY LANDFILL CLOSURE WHEREAS, the City of Wildwood (the City) is currently engaged in the closure of the former landfill and development of the former Department of Public Works site as part of the Back Bay Redevelopment Area Project (the Project); and WHEREAS, the City, in accordance with the New Jersey Local Public Contracts Law, advertised for bids to provide the City with topsoil for the Project (hereinafter the Contract) on June 4, 2025 pursuant to Resolution No. 224-5-25; and WHEREAS, the City received no submissions and subsequently readvertised the Contract as authorized by Resolution 262-6-25 passed at the June 25, 2025 Board of Commissioners meeting; and WHEREAS, the City received one (1) bid in connection with the second advertisement of the Contract when bids were opened on July 17, 2025 from Tuckahoe Sand & Gravel Company, Inc.; and WHEREAS, the bid has been reviewed by the City and it has been determined that Tuckahoe Sand & Gravel Company, Inc. submitted the lowest responsible bid, annexed hereto and incorporated by reference herein, for the services to be provided under the Contract in the amount of Three Hundred Eighty-Nine Thousand Five Hundred ($389,500.00) Dollars; and WHEREAS, the Chief Financial Officer of the City of Wildwood has certified the availability of funds; and WHEREAS, the City wishes to award the Contract to Tuckahoe Sand & Gravel Company, Inc. as set forth herein. CITY OF WILDWOOD Cape May County, New Jersey RESOLUTION RESOLUTION APPROVING THE PURCHASE OF A CCTV CAMERA SYSTEM CLOUD SERVER WHEREAS, the Department of Police (Department) recommends that the City of Wildwood (the City) procure a CCTV Camera CLOUD SERVER system for the City; and WHEREAS, the Department has researched vendors and determined that the sought-after equipment may be procured through a nationally-recognized and accepted cooperative purchasing contract between Omnia Partners and Bluum Technology; and WHEREAS, pursuant to N.J.S.A. 52:34-6.2b.(3) (as amended by P.L. 2011, c.139) and LFN 2012-10, a New Jersey municipality may purchase goods and services without public bidding under the Local Public Contracts Law through the use of a nationally-recognized and accepted cooperative purchasing contract that has been developed utilizing a competitive bidding or contracting process by another contracting unit within New Jersey or another state; and WHEREAS, Omnia Partners is a regional organization of governments operating under the laws of the State of Tennessee and is a political subdivision of the State of Tennessee; and WHEREAS, the subject cooperative purchasing contract was awarded by Omnia Partners to Bluum Technology utilizing a competitive contracting process; and WHEREAS, also pursuant to N.J.S.A. 52:34-6.2b.(3) (as amended by P.L. 2011, c.139) and LFN 2012-10, prior to making purchases under nationally-recognized and accepted cooperative purchasing contracts, the municipality must determine that the use of the cooperative purchasing contract shall result in cost savings after all factors, including charges for service, material, and delivery, have been considered; and WHEREAS, the Department has determined that the Citys use of the Omnia Partners cooperative purchasing contract to procure the aforementioned equipment will result in cost savings to the City; and WHEREAS, consistent with the Omnia Partners cooperative purchasing contract and needs of the City, Bluum Technology has submitted a proposal to provide a CCTV Camera system CLOUD SERVER for the City for the sum of $103,114.06; and WHEREAS, the Chief Financial Officer has certified that sufficient funds are available for this purchase. M-143 NOTICE TO BIDDERS NOTICE is hereby given that sealed bids will be received by the Borough of Avalon (hereinafter called the Owner) for: BAY PARK MARINA LIVING SHORELINE IMPROVEMENTS CONTRACT NO. M-143 Sealed bids for the above named Contract, which comprises the construction of living shoreline improvements, within the Borough of Avalon, Cape May County, New Jersey (Owner), will be received by the Borough Treasurer, Borough Hall, 3100 Dune Drive, Avalon, New Jersey 08202 on Wednesday, August 27, 2025 at 2:00 p.m. prevailing time, at which time they will be publicly unsealed and the contents publicly announced. The work shall be completed within 210 calendar days of the Contractors receipt of written Notice to Proceed. No bid will be received unless in writing on the forms furnished, and unless accompanied by bid security in the form of a bid bond, cashiers check, or a certified check made payable to the Borough of Avalon in an amount equal to 10% of the amount of the total bid, but not exceeding $20,000. The bid shall be accompanied by a Certificate of Surety on the form included in the Contract Docu-ments, from a surety company licensed to do business in the State of New Jersey, which shall represent that the surety company will provide the Contractor with the required bonds in the sums required in the Contract Documents and in a form satisfactory to the Owners Attorney and in compliance with the requirements of law. Bidders must use the prepared bid form which is contained in the Contract Documents. All Bid Proposals shall be either mailed or dropped off in person at the Borough Hall, 3100 Dune Drive, Avalon, NJ 08202 in a sealed envelope with the bidders name and address and clearly marked on the outside of envelope with the contract name, number and the name and address of the bidder that is submitting the proposal. A Pre-Bid Conference will be held in the Borough Hall, Council Chambers 3100 Dune Drive, Avalon, New Jersey 08202 on Thursday, August 14th, 2025 at 2:00 p.m. prevailing time. Attendance at the Pre-Bid Conference is not mandatory; however, Contractors are strongly encouraged to attend. Should the bidder not be the actual owner or leasee of such equipment, his certificate shall state the source from which the equipment will be obtained and, in addition, shall be accompanied by a signed certificate from the owner or person in control of the equipment definitely granting to the bidder the control of the equipment required during such time as may be necessary for the completion of that portion of the Contract for which it is necessary. The bidder shall comply with the documentation requirements set forth in the Article of the Information for Bidders, entitled, Bidder Submissions. The successful bidder will be required to submit bonds and proof of insurance on or before execution of their respective Contracts as explained in the Contract Documents. Further, P.L. 2021, c. 301 also amended N.J.S.A. 34:11-56.27 to require that any Contract for public work expressly stipulate that workers performing work under the contract shall not be paid less than the required prevailing wage rate. Contractors and their sureties shall be liable to the public body, any lessee to whom the public body is leasing a property or premises or to any lessor from whom the public body is leasing or will be leasing a property or premises, for any excess costs occasioned by the termination of their right to proceed with the work, or such part of the work as to which there has been a failure to pay required wages. Pursuant to N.J.S.A. 52:32-44, all business organizations that conduct business with a New Jersey government agency are required to be registered with the State of New Jersey. CITY OF WILDWOOD Cape May County, New Jersey RESOLUTION RESOLUTION APPROVING THE PURCHASE OF A CCTV CAMERA SYSTEM CLOUD SERVER WHEREAS, the Department of Police (Department) recommends that the City of Wildwood (the City) procure a CCTV Camera CLOUD SERVER system for the City; and WHEREAS, the Department has researched vendors and determined that the sought-after equipment may be procured through a nationally-recognized and accepted cooperative purchasing contract between Omnia Partners and Bluum Technology; and WHEREAS, pursuant to N.J.S.A. 52:34-6.2b.(3) (as amended by P.L. 2011, c.139) and LFN 2012-10, a New Jersey municipality may purchase goods and services without public bidding under the Local Public Contracts Law through the use of a nationally-recognized and accepted cooperative purchasing contract that has been developed utilizing a competitive bidding or contracting process by another contracting unit within New Jersey or another state; and WHEREAS, Omnia Partners is a regional organization of governments operating under the laws of the State of Tennessee and is a political subdivision of the State of Tennessee; and WHEREAS, the subject cooperative purchasing contract was awarded by Omnia Partners to Bluum Technology utilizing a competitive contracting process; and WHEREAS, also pursuant to N.J.S.A. 52:34-6.2b.(3) (as amended by P.L. 2011, c.139) and LFN 2012-10, prior to making purchases under nationally-recognized and accepted cooperative purchasing contracts, the municipality must determine that the use of the cooperative purchasing contract shall result in cost savings after all factors, including charges for service, material, and delivery, have been considered; and WHEREAS, the Department has determined that the Citys use of the Omnia Partners cooperative purchasing contract to procure the aforementioned equipment will result in cost savings to the City; and WHEREAS, consistent with the Omnia Partners cooperative purchasing contract and needs of the City, Bluum Technology has submitted a proposal to provide a CCTV Camera system CLOUD SERVER for the City for the sum of $103,114.06; and WHEREAS, the Chief Financial Officer has certified that sufficient funds are available for this purchase.
