CITY OF CAPE MAY PLANNING BOARD NOTICE OF HEARING TO WHOM IT MAY CONCERN: In compliance with the pertinent provisions of the Cape May City Zoning and Land Development Ordinance, and the New Jersey Municipal Land Use Act, N.J.S.A. 40:55D-1 et seq., notice is hereby given that a written application has been filed by the undersigned with the Cape May City Planning Board for clarification of a previous site plan approval concerning whether a deed restriction condition was imposed for maintenance of accessory landscaping together with and any and all other variances or waivers or other relief (including but not limited to amended site plan approval) the Board may reasonably require in the exercise of its discretion, and without further public notice. Without prejudice, applicant seeks clarification that no condition requiring the recording of a deed restriction to obligate the applicant to maintain in perpetuity onsite landscaping was imposed in connection with a preliminary and final site plan approval granted by the Planning Board at hearing held on June 11, 2024 and memorialized by Resolution No. 07-09-2024:1 adopted on July 9, 2024. This prior approval allows the applicant to expand and renovate the existing La Mer Beachfront Resort with the demolition of existing buildings and construction to allow for 51 new hotel units and a 202 seat banquet/special events building to be used seasonally, along with related improvements. With this application, no new development is proposed other than what was previously approved. All of the above described development is proposed on property shown as Lots 6-24 in Block 1146 on the Cape May City Tax Map, which property is located at 1317 Beach Avenue. Public hearing on the above mentioned application has been scheduled for May 27, 2025, at 6:30 p.m., 643 Washington Street, Cape May, New Jersey, at which time and place any interested party (as defined in N.J.S.A. 40:55D-4) will have an opportunity to be heard. All documents relating to this application are on file with the Board Secretary and may be inspected by the public from Monday through Friday 7:30 a.m. to 3:30 p.m. in the office of Construction/Zoning, at City Hall, 643 Washington Street, Cape May, New Jersey.
