CITY OF CAPE MAY PLANNING BOARD PUBLIC NOTICE PLEASE TAKE NOTICE that 413-415 Washington St LLC, has applied to the Planning Board of the City of Cape May for site plan approval and variances, in order to conduct interior and exterior renovations to the existing mixed-use retail/residential structure located at 413-415 Washington Street, Cape May, NJ 08204, also known as Lot 1 in Block 1043 on the tax map of the City of Cape May, Cape May County, New Jersey, including converting the storage space on the first and second floors to retail space, converting the residential space on the second floor to retail space, renovating the residential space on the third floor, and other various improvements. More specifically, the Applicant is seeking the following relief: 1.Preliminary and final site plan approval, pursuant to the Zoning, Site Plan Review and applicable Land Use Development Ordinances of the City of Cape May as well as the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-46 and N.J.S.A. 40:55D-50; 2.Variance relief from the Zoning Ordinance of the City of Cape May and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) as follows: a.Minimum required number of parking spaces, where 8 spaces are required for the existing use, 16 spaces are required for the proposed use, zero spaces exist and zero spaces are proposed; b.Maximum permitted lot coverage, where 95% is permitted and 99.7% exists, which is an existing nonconforming condition and will not change. 3.Waivers from Details Required for C & D Variances & Conditional Use Approval Checklist Waivers for: a.Checklist Item #27, plans and profiles of proposed utility layouts such as sanitary sewer lines, storm drains, water, gas and electric, showing feasible connections to existing or proposed utility systems; b.Checklist Item #28, design calculations showing proposed facilities prepared in accordance with the appropriate drainage runoff requirements; c.Checklist Item #33, landscaping plan, including types, quantity, size and location of all proposed plants. The scientific and common names of all plants must to be included on the plans. 4.Waivers from the City of Cape May Site Plan Preliminary Plan Details Wavers from: a.Ordinance section 417-5C(3)(e), existing and proposed contours; b.Ordinance section 417-5C(3)(o), stormwater drainage system design; c.Ordinance section417-5C(3)(p), landscaping & planting design; and d.Ordinance section 417-5C(3)(q), outdoor lighting design. 5.Any other bulk, dimensional and accessory variance relief or exceptions from the Zoning, Site Plan Review and applicable Land Use Development Ordinances of the City of Cape May and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) which may be required, including, but not limited to, side yard setbacks, front yard setbacks, rear yard setbacks, building coverage, lot coverage, density, landscaping, parking at the Property in conjunction with the Residential Site Improvement Standard and curb cuts; and 6.The Applicant may also apply for such variance relief, exceptions, waivers, permits, approvals or licenses that are deemed necessary or appropriate by the Applicant or the Board, which may arise during the course of the hearing process.
