Minimum required front yard setback, where a minimum of 10 feet is required and 4.14 feet is proposed; d. Minimum required side yard setback, where a minimum of 6 feet is required and 4.98 feet and 5.47 feet are proposed; e. Maximum permitted building coverage, where a maximum of 60% is permitted and 61.6% is proposed; f. Maximum permitted impervious lot coverage, where a maximum of 70% is permitted and 76% is proposed; g. Minimum required contiguous raised curb with landscaped frontage, whereas a minimum of 25% of the lot frontage shall be contiguous raised curb with landscaping to the building line, and 11.7% is proposed; 5. Variance relief from the Land Use Development Ordinance of the City of Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) as follows for proposed Lot 18.02, which is proposed to be developed with a single-family dwelling: a. Minimum required lot area, where a minimum of 3,600 square feet is required and 3,240 square feet is proposed; b. Minimum required lot frontage, where a minimum of 40 feet is required and 36 feet is proposed; c. Minimum required front yard setback on Ocean Avenue, where a minimum of 10 feet is required and 4.75 feet is proposed; d. Minimum required front yard setback on Glenwood Avenue, where a minimum of 10 feet is required and 4.05 feet is proposed; e. Maximum permitted building coverage, where a maximum of 45% is permitted and 51.4% is proposed; f. Maximum permitted driveway curb cut, where a maximum of 24 feet is permitted and the proposed curb cut exceeds 24 feet; g. Minimum required contiguous raised curb with landscaped frontage, whereas a minimum of 25% of the lot frontage shall be contiguous raised curb with landscaping to the building line, and 17.5% is proposed; h. CITY OF WILDWOOD Cape May County, New Jersey RESOLUTION EMERGENCY REPAIR WELL #49 WHEREAS, the City of Wildwood had an emergency which required immediate attention for an Emergency Repair Declaration due to an Emergency at Well #49 at Myrtle Ave & Park Blvd in Wildwood Crest, NJ on July 5, 2025, and; WHEREAS, the Wildwood Water Utility Engineer & Director has inspected the site and determined in writing that an emergency situation did indeed exist. The Emergency Declaration Letter annexed hereto as Exhibit A, and; WHEREAS, the Local Public Contracts Law (NJSA 40A:11-6) Emergency Contracts requires that any contract may be negotiated or awarded for a contracting unit without public advertising for bids or quotes when an emergency affecting the public health, safety or welfare requires immediate performance of services, and; WHEREAS, A.C. ORDINANCE NO. 1-2025 MIDDLE TOWNSHIP WATER DISTRICT NO. 1 CAPE MAY COUNTY, NEW JERSEY AN ORDINANCE FURTHER AMENDING ORDINANCE NO. 1-2011 ENTITLED AN ORDINANCE TO REGULATE THE OPERATION OF MIDDLE TOWNSHIP WATER DISTRICT NO. 1 CAPE MAY COUNTY, NEW JERSEY; ESTABLISHING RULES, REGULATIONS AND STANDARDS GOVERNING THE PROVISION OF SERVICES AND SALE OF WATER TO CONSUMERS CONNECTED OR TO BE CONNECTED WITH THE WATER MAINS OF THE WATER DISTRICT; IMPOSING PENALTIES FOR VIOLATIONS THEREOF; AND REVISING AND SUPERCEDING PRIOR ORDINANCES INCLUDING BUT NOT LIMITED TO Ord. 1-2024, 1-2022, 1-2015, 1-2014, 1-2011, 3-2008, 8-2001, 4-1972, 6-1989, and 1-1963, BE IT ORDAINED by the Board of Commissioners of Middle Township Water District No. 1 of the Township of Middle, County of Cape May and State of New Jersey, as follows: Section I. Ordinance No. 1-2011, Section Ill Rules and Regulations are amended as follows: Subsection H, Paragraph (1), Permanent Discontinuance. Permanent discontinuance of service to any premises will be affected by the District upon receipt of a written request from the owner or owners along with payment, in advance, of a discontinuance fee of Fifteen Hundred ($1,500.00) Dollars to cover the Districts expenses. The District shall remove the meter, if any, and service will be turned off at the curb stop or the water main. After permanent discontinuance of service, service cannot be resumed unless a reconnection fee of $6,000.00 is paid for residential water service and $9,000.00 for commercial water service. This change is for voluntary shut-off requests only. Shut off or turn on of water due to customer requests, or leaks at the property will be Two Hundred ($200.00) Dollars during the hours of 8:00am to 4:00pm. Outside of normal business hours that rate will be Three Hundred and Fifty Dollars ($350.00). This Ordinance No. 1-2025 shall take effect in the time and manner as prescribed by law. Superior Court of New Jersey, Cape May County, Chancery Division Docket No.: CPM-C-32-25 From the State of New Jersey to Andrew Kinka: Michelle Dunn has filed a lawsuit against you in the Superior Court of New Jersey. The Complaint alleges that Andrew Kinka did not comply with his obligations under the terms of the Settlement Agreement; Andrews breaches are material to the Agreement and affect the purpose of the Agreement in a vital way; Andrews representations with regard to the Property value as well as his ability and/ or intention to comply with the terms of the Settlement Agreement were false and misleading; Michelle would not have entered the Settlement Agreement had she known of Andrews misrepresentation in this respect; The Settlement Agreement was therefore based on a fundamental mistake, which was either shared by both parties, or was based on an intentional misrepresentation by Andrew; It would be unjust for Andrew to retain the benefit conferred upon him by Michelle through the Parties jointly borrowed funds, as well as the Settlement Agreement, especially when he has not complied with its terms; Andrew will be unjustly enriched by retaining and selling the Property without repaying the Parties joint $250,000 loan, as well as his share of the payments already made by Michelle; Michelle is a 50% rightful owner of the Property and therefore is entitled to partition of the Property by sale.
