CITY OF WILDWOOD Cape May County, New Jersey RESOLUTION A RESOLUTION AUTHORIZING THE AWARD OF A PROFESSIONAL SERVICES AGREEMENT TO the DEWEESE LAW FIRM, P.C. TO SERVE AS CONFLICT TAX COUNSEL WHEREAS, a property owner in the City of Wildwood (the City) has filed a tax appeal against the City seeking a reduction in the assessed value of the property; and WHEREAS, the Citys current tax appeal counsel has a conflict of interest with the subject property owner and cannot represent the Citys interest given the rules governing the practice of law; and WHEREAS, the City is therefore in need of a Conflict Tax Counsel and The DeWeese Law Firm, P.C. has submitted a proposal to the City to serve as Conflict Tax Counsel; and WHEREAS, the Board of Commissioners has reviewed the same and wishes to enter into an agreement with The DeWeese Law Firm, P.C. for part-time Conflict Tax Counsel services as a non-fair and open contract pursuant to Pay to Play laws, N.J.S.A. 19:44A-20.4 et seq; and WHEREAS, The DeWeese Law Firm, P.C. has completed and submitted a Business Entity Disclosure Certification which certifies that said entity has not made any reportable contributions to a political or candidate committee in the City of Wildwood in the previous one year, and that the contract will prohibit it from making any reportable contributions for the term of the contract; and WHEREAS, the Local Public Contract Law N.J.S.A. 40A:11-1, et seq. permits for the adoption of a resolution authorizing the award of a contract for professional services without competitive bids; and WHEREAS, the Chief Financial Officer of the City of Wildwood has certified the availability of funds. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Wildwood, County of Cape May, State of New Jersey as follows: 1.That the provisions of the above preamble of this Resolution are hereby incorporated by reference as if set forth at length. 2.That the Board of Commissioners hereby approves a professional services agreement with The DeWeese Law Firm, P.C., 3200 Pacific Ave, Wildwood, NJ 08260 as more specifically set forth in the proposal annexed hereto and incorporated by reference herein, to serve as conflict tax counsel in an amount not to exceed Five Thousand ($5,000.00) Dollars. 3.The Mayor and City Clerk are hereby authorized and directed to execute the contract on behalf of the City, and to take any and all other actions necessary to effectuate the purposes thereof. 4.The Business Disclosure Entity Certification and a copy of the agreement shall be placed on the file with this Resolution. 5.That this Resolution shall be published according to law.
