CITY OF NORTH WILDWOOD COUNTY OF CAPE MAY, NEW JERSEY ORDINANCE NO. 1985 AN ORDINANCE AMENDING ORDINANCE 1078, AS AMENDED BY ORDINANCE NOS. 1265, 1390 AND 1762, AS CODIFIED IN CHAPTER 71, BEACH PATROL PENSION PLAN BE IT ORDAINED, by the Council of the City of North Wildwood in the County of Cape May, State of New Jersey, as follows: Section One. The portion of Ordinance #1078, as amended and supplemented by Ordinance Nos. 1265, 1390 and 1762, that has been codified in the Code of the City of North Wildwood at 71-20, Definitions, is hereby amended to the extent that the definition of YEAR OF SERVICE shall henceforth read as follows: YEAR OF SERVICE Consists of such part of the calendar year as the Lifeguard Force is normally employed. At least 360 hours worked shall constitute a year of service. Section Two. The portion of Ordinance #1078, as amended and supplemented by Ordinance Nos. 1265, 1390 and 1762, that has been codified in the Code of the City of North Wildwood at 71-20.7D is hereby amended to the extent that 71-20.7D shall henceforth read as follows: D.Operating procedures. (1)The members of the North Wildwood Lifeguard Pension Commission shall annually elect a Chairperson from among the membership and shall meet a minimum of twice per year. (2)All acts and decisions of the Lifeguard Pension Commission shall be by majority vote of those present at any duly called meeting. A duly called meeting shall be that which is attended by at least three members of the Commission. All decisions shall be binding and conclusive, subject to a claim review procedure which might be established by the Commission. No Commission member shall vote or otherwise participate in a decision pertaining specifically to his own benefits from the plan. (3)The City Administrator shall provide the Lifeguard Pension Commission with the facilities needed for the conduct of its business and the preservation of its records. (4)The Lifeguard Pension Commission may request and receive assistance from City officers and employees, including but not limited to a secretary, the City Clerk and the Chief Financial Officer, and may employ independent counsel. (5)The members of the Lifeguard Pension Commission accept no liability for any act or omission except those for which they are responsible under the terms of this plan. All liability insurance or security bonds required for members of the Commission shall be provided for out of the proceeds of the pension plan fund. (6)Pension Certification Request Procedure. (a)Beach Patrol member informs, in writing, of intent to retire from the NWBP. He/she submits a letter of request for certification of their Lifeguard Pension Contributions to the Beach Patrol Chief, Lifeguard Pension Commission, and Human Resources. The request letter for certification shall include the following information: [i] Full name. [ii] Years of service with NWBP. [iii] Updated mailing address where payment(s) shall be sent. (b)North Wildwood Human Resources & Chief Financial Officer shall determine eligibility status. Eligibility shall be constituted by the following: [i] 20 Years of Service, including the final period of 10 consecutive years, serving with the North Wildwood Beach Patrol. A year of service shall be constituted by 360 hours worked. (c)If retiree is deemed eligible, HR & CFO shall submit back up documentation and pension calculation to the Lifeguard Pension Commission for review and certification. [i] The annual pension amount shall be equal to 50% of the average of the last three (3) years salary received by the retiree during his/her employment with the North Wildwood Beach Patrol. (d)Lifeguard Pension Commission shall review and vote on Resolution to certify pension request. If approved, Commission shall submit Resolution and backup documentation to the Office of the City Clerk for City Council approval. (e)City Council to consider Resolution to approve Commissions pension certification recommendation. If approved, City Clerk shall submit approval to HR/CFO and to the Commission. (f)If eligible to begin, retiree shall receive pension payments on a quarterly basis. (7)Pension Reimbursement Request Procedure. (a)Beach Patrol member resigns, in writing, from the North Wildwood Beach Patrol. Within 12 months of resignation, he/she submits a letter of request for reimbursement of their Lifeguard Pension Contributions to the Beach Patrol Chief, Lifeguard Commission, and Human Resources. The request letter shall include the following information: [i] Full name [ii] Years of service with NWBP [iii] Updated mailing address where payment shall be sent (b)North Wildwood HR/CFO shall review request and calculate contributions to be reimbursed. Calculation shall be then sent to Lifeguard Pension Commission for review. (c)Lifeguard Pension Commission shall review calculations and eligibility and vote on Resolution to approve reimbursement requests. If approved, Commission shall submit Resolution, letters, and calculations to the Office of the City Clerk for City Council approval. (d)City Council to review Resolution to approve Commissions reimbursement recommendation. If approved, City Clerk shall submit approval to HR/CFO. (e) HR/CFO to pay out requester in the contribution amount calculated previously. Payment shall be mailed via check to mailing address provided in the letter of request. Section Three. If any portion of this Ordinance is determined to be invalid by a court of competent jurisdiction, that determination shall have no effect upon the remainder of this Ordinance, which shall remain valid and operable. Section Four. All Ordinances or parts of Ordinances inconsistent with this Ordinance, to the extent of such inconsistencies only, be and the same hereby are repealed. Section Five. CITY OF WILDWOOD Cape May County, New Jersey RESOLUTION EMERGENCY REPAIR WELL #49 WHEREAS, the City of Wildwood had an emergency which required immediate attention for an Emergency Repair Declaration due to an Emergency at Well #49 at Myrtle Ave & Park Blvd in Wildwood Crest, NJ on July 5, 2025, and; WHEREAS, the Wildwood Water Utility Engineer & Director has inspected the site and determined in writing that an emergency situation did indeed exist. The Emergency Declaration Letter annexed hereto as Exhibit A, and; WHEREAS, the Local Public Contracts Law (NJSA 40A:11-6) Emergency Contracts requires that any contract may be negotiated or awarded for a contracting unit without public advertising for bids or quotes when an emergency affecting the public health, safety or welfare requires immediate performance of services, and; WHEREAS, A.C. ORDINANCE NO. 1-2025 MIDDLE TOWNSHIP WATER DISTRICT NO. 1 CAPE MAY COUNTY, NEW JERSEY AN ORDINANCE FURTHER AMENDING ORDINANCE NO. 1-2011 ENTITLED AN ORDINANCE TO REGULATE THE OPERATION OF MIDDLE TOWNSHIP WATER DISTRICT NO. 1 CAPE MAY COUNTY, NEW JERSEY; ESTABLISHING RULES, REGULATIONS AND STANDARDS GOVERNING THE PROVISION OF SERVICES AND SALE OF WATER TO CONSUMERS CONNECTED OR TO BE CONNECTED WITH THE WATER MAINS OF THE WATER DISTRICT; IMPOSING PENALTIES FOR VIOLATIONS THEREOF; AND REVISING AND SUPERCEDING PRIOR ORDINANCES INCLUDING BUT NOT LIMITED TO Ord. 1-2024, 1-2022, 1-2015, 1-2014, 1-2011, 3-2008, 8-2001, 4-1972, 6-1989, and 1-1963, BE IT ORDAINED by the Board of Commissioners of Middle Township Water District No. 1 of the Township of Middle, County of Cape May and State of New Jersey, as follows: Section I. The portion of Ordinance #1078, as amended and supplemented by Ordinance Nos. 1265, 1390 and 1762, that has been codified in the Code of the City of North Wildwood at 71-20, Definitions, is hereby amended to the extent that the definition of YEAR OF SERVICE shall henceforth read as follows: YEAR OF SERVICE Consists of such part of the calendar year as the Lifeguard Force is normally employed. At least 360 hours worked shall constitute a year of service. Section Two. The portion of Ordinance #1078, as amended and supplemented by Ordinance Nos. 1265, 1390 and 1762, that has been codified in the Code of the City of North Wildwood at 71-20.7D is hereby amended to the extent that 71-20.7D shall henceforth read as follows: D.Operating procedures. (1)The members of the North Wildwood Lifeguard Pension Commission shall annually elect a Chairperson from among the membership and shall meet a minimum of twice per year. (2)All acts and decisions of the Lifeguard Pension Commission shall be by majority vote of those present at any duly called meeting. A duly called meeting shall be that which is attended by at least three members of the Commission. All decisions shall be binding and conclusive, subject to a claim review procedure which might be established by the Commission. No Commission member shall vote or otherwise participate in a decision pertaining specifically to his own benefits from the plan. (3)The City Administrator shall provide the Lifeguard Pension Commission with the facilities needed for the conduct of its business and the preservation of its records. (4)The Lifeguard Pension Commission may request and receive assistance from City officers and employees, including but not limited to a secretary, the City Clerk and the Chief Financial Officer, and may employ independent counsel. (5)The members of the Lifeguard Pension Commission accept no liability for any act or omission except those for which they are responsible under the terms of this plan. All liability insurance or security bonds required for members of the Commission shall be provided for out of the proceeds of the pension plan fund. (6)Pension Certification Request Procedure. (a)Beach Patrol member informs, in writing, of intent to retire from the NWBP. He/she submits a letter of request for certification of their Lifeguard Pension Contributions to the Beach Patrol Chief, Lifeguard Pension Commission, and Human Resources. The request letter for certification shall include the following information: [i] Full name. [ii] Years of service with NWBP. [iii] Updated mailing address where payment(s) shall be sent. (b)North Wildwood Human Resources & Chief Financial Officer shall determine eligibility status. Eligibility shall be constituted by the following: [i] 20 Years of Service, including the final period of 10 consecutive years, serving with the North Wildwood Beach Patrol. A year of service shall be constituted by 360 hours worked. (c)If retiree is deemed eligible, HR & CFO shall submit back up documentation and pension calculation to the Lifeguard Pension Commission for review and certification. [i] The annual pension amount shall be equal to 50% of the average of the last three (3) years salary received by the retiree during his/her employment with the North Wildwood Beach Patrol. (d)Lifeguard Pension Commission shall review and vote on Resolution to certify pension request. If approved, Commission shall submit Resolution and backup documentation to the Office of the City Clerk for City Council approval. (e)City Council to consider Resolution to approve Commissions pension certification recommendation. If approved, City Clerk shall submit approval to HR/CFO and to the Commission. (f)If eligible to begin, retiree shall receive pension payments on a quarterly basis. (7)Pension Reimbursement Request Procedure. (a)Beach Patrol member resigns, in writing, from the North Wildwood Beach Patrol. Within 12 months of resignation, he/she submits a letter of request for reimbursement of their Lifeguard Pension Contributions to the Beach Patrol Chief, Lifeguard Commission, and Human Resources. The request letter shall include the following information: [i] Full name [ii] Years of service with NWBP [iii] Updated mailing address where payment shall be sent (b)North Wildwood HR/CFO shall review request and calculate contributions to be reimbursed. Calculation shall be then sent to Lifeguard Pension Commission for review. If approved, Commission shall submit Resolution, letters, and calculations to the Office of the City Clerk for City Council approval. (e) HR/CFO to pay out requester in the contribution amount calculated previously. Payment shall be mailed via check to mailing address provided in the letter of request. Section Three. If any portion of this Ordinance is determined to be invalid by a court of competent jurisdiction, that determination shall have no effect upon the remainder of this Ordinance, which shall remain valid and operable. NOTICE OF AVAILABILITY OF REQUESTS FOR QUALIFICATIONS AND PROPOSALS (RFQP) FOR SUPPLY, INSTALLATION AND SERVICING OF VENDING MACHINES CITY OF NORTH WILDWOOD 901 Atlantic Avenue North Wildwood, New Jersey 08260 (609) 522-2030 PLEASE TAKE NOTICE that, pursuant to N.J.S.A. 40A:11-4.1, et. seq., the City of North Wildwood is requesting qualifications and proposals from vendors for a contract for the supply, installation and servicing of vending machines at various locations in the City of North Wildwood. The qualifications and proposals are being solicited through a fair and open process in accordance with N.J.S.A. 19:44A-20.5, et. seq. Sealed qualifications and proposals will be received by the City Clerk of North Wildwood in Council Chambers, City Hall, 901 Atlantic Avenue, North Wildwood, New Jersey, 08260 on Wednesday, October 29, 2025 at 10:00 a.m., prevailing time. Specifications and forms of bids for the proposed contract are available via www.northwildwood.com or at the Office of the City Clerk at the address listed hereinabove (609-522-2030) and may be inspected/obtained by prospective contractors during regular business hours. Proposals must be made on standard proposal forms in the manner designated therein and required by the specifications and must be enclosed in a sealed envelope, bearing the name and address of the contractor and name of the contract (Supply, Installation and Servicing of Vending Machines) on the outside, addressed as follows: City Clerk, City of North Wildwood, 901 Atlantic Avenue, North Wildwood, NJ 08260. In the event that it becomes necessary to clarify or revise this RFQP, such clarification or revision will be by addendum. Any addendum to this RFQP will become part of this RFQP and part of any contract awarded as a result of this RFQP. ALL RFQP ADDENDA WILL BE ISSUED ON THE CITY OF NORTH WILDWOODS WEB SITE. Therefore, interested contractors should check the website on a daily basis from time of RFQP issuance through bid opening. It is the sole responsibility of the contractor to be knowledgeable of all addenda related to this contract. Contractors are required to comply with the requirements of the Public Law, 1975, C.127 N.J.S.A. 34:11-56, 25 et. seq. as amended in Chapter 64 of the Laws of 1974 and P.L. 1977 Ch. 33, N.J.S.A. 52:25-24.2 which requires, as to any contractor that is not a sole proprietor, a statement setting forth the names and addresses of all stockholders in the corporation or partnership who own 10% or more of its stock, of any class, or of all individual partners in the partnership who own 10% or greater interest therein, as the case may be. Contractors are required to comply with the requirements of N.J.S.A. 10:5-31, et. seq. and N.J.A.C. 17:27. The statutory and regulatory language of those statutes and administrative regulations are incorporated into the specifications and the contract with the successful contractor by reference. Contractors are required to submit a New Jersey Business Registration Certificate pursuant to the requirements of N.J.S.A. 52:32-44. Contractors are required to submit an ownership disclosure statement pursuant to the requirements of N.J.S.A. 52:25-24.2. Prospective contractors are required to comply with the requirements of N.J.S.A. 10:5-31 et seq and N.J.A.C. 17:24 (Contract Compliance and Affirmative Action for Public Contracts). A copy of the Law is available at the City Clerks Office upon request and is made a part of the bid specifications. Prospective contractors are required to comply with the requirements of N.J.S.A. 19:44A-20.27. Business entities are advised of their responsibility to file an annual disclosure statement of political contributions with the New Jersey Election Law Enforcement Commission (ELEC), if they receive contracts in excess of $50,000 from public entities in a calendar year. The successful contractor shall be required to comply with the provisions of the New Jersey Prevailing Wage Act. Upon receipt of qualifications and proposals, the City Clerk shall transmit copies of each proposal to a review committee consisting of North Wildwoods Mayor, City Administrator and Chief Financial Officer. Proposals will be evaluated on the basis of the most advantageous, price and other factors considered. The evaluation will consider: a.Experience and reputation of the prospective contractor in the field that is the subject matter of the contract; b.Knowledge of the City of North Wildwood and issues that are unique to the community based on its status as a seasonal seaside resort community and the subject matter to be addressed under the contract; c.Compensation proposal; and d.Other factors as demonstrated to be in the best interest of the City of North Wildwood. Upon completion of the review process, the review committee shall transmit its findings and recommendations to North Wildwood City Council which shall award the subject contract by resolution.
