REQUEST FOR RELEASE OF FUNDS On or about July 18, 2025, the City of North Wildwood (City) will submit a request to the NJ Department of Community Affairs (NJDCA) for the release of Community Development Block Grant (CDBG) funds to undertake the following project, pursuant to 24 CFR Part 58, Section 58.36: Removal of Architectural Barriers to Accessibility FY 2025 CDBG funding of $400,000 for the construction of an Americans with Disabilities Act (ADA)-compliant access ramp, stairs and other related work Project location: East 18th Avenue and the Boardwalk, North Wildwood, NJ Total estimated project cost: $796,848 The proposed improvements to safely access the Boardwalk at 18th Avenue include demolition of the existing ramp within the active street, restoration of the roadway where disturbed; construction of fully ADA compliant access under the boardwalk to the existing ADA-compliant, at-grade bicycle/pedestrian path on the beach, construction of a new fully ADA-compliant access ramp on the beach between the compliant at-grade path and the Boardwalk and the construction of ADA-compliant steps. The project is expected to be completed by November 2026. FINDING OF NO SIGNIFICANT IMPACT The City has determined that the above project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City, 901 Atlantic Avenue, North Wildwood, NJ, and may be examined or copied weekdays from 9:00 a.m. to 4:00 p.m. PUBLIC COMMENTS Any individual, group or agency may submit written comments on the ERR to the City of North Wildwood, Clerks Office, Municipal Building, 901 Atlantic Avenue, North Wildwood, NJ 08260, or to sjett@northwildwood.com. All comments received by July 17, 2025, will be considered by the City prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The City certifies to the NJDCA that Patrick Rosenello, in his capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. NJDCAs approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Wildwood to use Program funds. OBJECTIONS TO RELEASE OF FUNDS NJDCA will consider objections to its release of funds and the City of North Wildwood for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a)The certification was not executed by the Certifying Officer or other officer of the City of North Wildwood. (b)The City of North Wildwood has omitted a step or failed to make a decision or finding required by HUD regulation at 24 CFR Part 58. (c)The grant recipient or other participants in the development process have committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d)Another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. LEGAL NOTICE PLEASE TAKE NOTICE that the undersigned, Edward J. Wurster and Elizabeth Wurster (collectively, the Applicant) have made application to the City of North Wildwood Planning Board (the Board) for a property commonly known as 110 W. 15th Avenue, North Wildwood, New Jersey 08260, and more specifically designated as Lot 12 in Block 174 (the Property) on the Tax and Assessment Map of the City of North Wildwood, Cape May County, New Jersey, in order to demolish the existing dwelling and construct a new single-family dwelling and private swimming pool at the undersized lot (the Project). The Property is located in the R-2 zoning district. The Applicant is seeking the following: 1.Site plan approval, if required, pursuant to the Land Use Development Ordinance of the City of North Wildwood as well as the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-46 and N.J.S.A. 40:55D-50; 2.Variance relief from the Land Use Development Ordinance of the City of North Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(d) as follows: a.D(6) building height variance, where 24 feet from base flood elevation is permitted for lots 30 feet in width or less, 19 feet 6 inches from elevation 4.78 feet (driveway) or 15 feet 3 and three-eighths inches from base flood elevation (9.0 feet) exists, and 28 feet and 7 and three-eighths inches from base flood elevation is proposed, which exceeds the maximum permitted height by more than 10%; 3.Variance relief from the Land Use Development Ordinance of the City of North Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) as follows: a.Minimum required lot area, where 4,000 square feet is required and 3,000 square feet exists, which is a preexisting nonconforming condition and will not change as a result of the proposed project; b.Minimum required lot frontage, where 40 feet is required and 30 feet exists, which is a preexisting nonconforming condition and will not change as a result of the proposed project; c.Minimum required lot width, where 40 feet is required and 30 feet exists, which is a preexisting nonconforming condition and will not change as a result of the proposed project; d.Design waiver, or variance required, for minimum contiguous raised curb where 50% of the lot width is required to be contiguous raised curb and less than 50% is proposed. 4.Any other bulk, dimensional and accessory variance relief or exceptions from the Land Use Development Ordinance of the City of North Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) which may be required, including, but not limited to, side yard setbacks, front yard setbacks, rear yard setbacks, setbacks to roof overhangs, building height, number of stories, building coverage, lot coverage, distance between structures, accessory structure setbacks, elevation of and distance to HVAC equipment, number, landscaping, location or dimensions of parking at the Property in conjunction with the Residential Site Improvement Standards and curb cuts; and 5.The Applicant may also apply for such variance relief, exceptions, waivers, permits, approvals or licenses that are deemed necessary or appropriate by the Applicant or the Board, which may arise during the course of the hearing process. CITY OF NORTH WILDWOOD COUNTY OF CAPE MAY, NEW JERSEY ORDINANCE NO. 1977 AN ORDINANCE AMENDING ORDINANCE 1605, AS AMENDED BY ORDINANCE 1835, AS CODIFIED IN CHAPTER 75, POLICE DEPARTMENT BE IT ORDAINED, by the Council of the City of North Wildwood in the County of Cape May, State of New Jersey, as follows: Section One. The portion of Ordinance 1605, adopted March 6, 2012, as amended by Ordinance 1835, adopted April 6, 2021, that has been codified in the Code of the City of North Wildwood at 75-1A is hereby amended to the extent that the reference to twenty patrolmen shall henceforth read twenty-five patrolmen. Section Two. If any portion of this Ordinance is determined to be invalid by a court of competent jurisdiction, that determination shall have no effect upon the remainder of this Ordinance, which shall remain valid and operable. Section Three. All Ordinances or parts of Ordinances inconsistent with this Ordinance, to the extent of such inconsistencies only, be and the same hereby are repealed. Section Four. ADVERTISEMENT BOARDWALK REPLACEMENT, PHASE 1 CITY OF NORTH WILDWOOD Notice is hereby given that sealed bids for the construction of the above referenced project will be received by the Mayor and Council of the City of North Wildwood and opened and read in public at the North Wildwood City Hall Court Room located at 901 Atlantic Avenue, North Wildwood, New Jersey 08260 at 2:00 p.m. prevailing time, on Wednesday, July 23, 2025. Sealed bids shall be submitted to the City Clerk located at 901 Atlantic Avenue, North Wildwood, New Jersey 08260 by 2:00 PM on Wednesday, July 23, 2025. This project will be partially funded with Federal funds from the United States Department of Commerce, Economic Development Administration and therefore is subject to Federal laws and regulations associated with that program. Project Description The Bid includes complete demolition of the existing reinforced concrete and timber boardwalk structure and access ramps and stairs and construction of a new natural hard wood boardwalk including ADA compliant access improvements, timber hardwood piles, timber hardwood framing, timber hardwood decking, aluminum railings, site lighting and electrical improvements, concrete pathways, and all else necessary and incidental to the intended improvements. Bidders are required to comply with the subcontractor identification requirements of the Local Public Contract Law (40A:11-16). The successful Bidder must furnish a 100% Performance Bond and 100% Labor and Material Payment Bond in conformity with the requirements of the Contract Documents. The successful Bidder will be required, upon final payment, to furnish a two-year General Maintenance Bond acceptable to the City of North Wildwood, in conformity with the requirements of the Contract Documents. CITY OF NORTH WILDWOOD COUNTY OF CAPE MAY, NEW JERSEY ORDINANCE NO. 1978 AN ORDINANCE AMENDING CHAPTER 138, BEACHES, OF THE CODE OF THE CITY OF NORTH WILDWOOD WHEREAS, the City of North Wildwood, the State of New Jersey Department of Environmental Protection and the United States Department of the Interior Fish and Wildlife Service have mutually adopted and executed a City of North Beach Management Plan for the Protection of Federally and State-Listed Species (hereinafter Beach Management Plan); and WHEREAS, Mayor and Council deem it prudent and appropriate to ensure that the Citys beach regulations are in accordance with said Beach Management Plan. THEREFORE, BE IT ORDAINED, by the Council of the City of North Wildwood in the County of Cape May, State of New Jersey, as follows: Section One. The portion of Ordinance 334, as amended, that has been codified in the Code of the City of North Wildwood at 138-3O is hereby amended to the extent that 138-3O shall henceforth read as follows: O. To allow dogs, cats or any other domestic animals upon the beaches of the City of North Wildwood, with the following exceptions: (1)Dogs may be permitted upon the oceanfront beaches of the City of North Wildwood, from the jetty at 2nd Avenue south to 26th Avenue, from 6:00 a.m. to 9:00 a.m., and from 5:30 p.m. to 9:00 p.m. a.Dogs on the beach must be on a leash of not greater than eight feet in length. b.Dogs are not permitted on dunes, in any environmentally sensitive area, or in any other area restricted by appropriate signage as determined by the City of North Wildwood. c.Any person or association of persons not undertaking, in connection with a dog in his/her/their control, the immediate cleanup and disposal of dog solid waste on the beach, as outlined in 126-12, Soiling and defilement by dogs, of the Code of the City of North Wildwood, shall be subject, upon conviction, to the fines set forth in 126-13A. (2)No dogs, cats or any other domestic animals shall be permitted on the Hereford Inlet Beach, from the jetty at 2nd Avenue westward to the terminus of the beach at New York Avenue, at any time during the year. Section Two. The portion of Ordinance 632, as amended, that has been codified in the Code of the City of North Wildwood at 138-6 is hereby amended to the extent that 138-6 shall henceforth read as follows: 138-6. Operation of vehicles for certain purposes allowed. It shall be lawful to operate a motor vehicle, licensed under this article, on the beaches of this City, pursuant to the terms of this article, only as follows: A.For the purpose of sport surf fishing and any other recreational purpose deemed appropriate and approved by the Chief of Police or his designee or at the direction of the Director of Public Safety, the dates and times for said purposes shall be in accordance with the Beach Management Plan of the City of North Wildwood. Such dates and times, and all other appertaining provisions, rules and regulations, shall be clearly explained and listed on a form of application prepared by the City Clerk for permission to operate vehicles on the beaches of the City of North Wildwood. Said form of application shall be approved by Resolution of Council, and shall be updated by Resolution of Council at such time as the provisions, rules and regulations of the Citys Beach Management Plan are amended and/or supplemented by a subsequent Beach Management Plan. Said Resolutions and the corresponding updated forms of application shall be placed on file with this Ordinance in the Office of the City Clerk. B.For any other purpose deemed appropriate for commercial vehicles by the Chief of Police of the City of North Wildwood or his designee or at the direction of the Director of Public Safety. C.For the purpose of operating a beach tram, which shall be operated by the City of North Wildwood or an individual or entity under contract with the City of North Wildwood. Section Three. The portion of Ordinance 632, as amended, that has been codified in the Code of the City of North Wildwood at 138-7 is hereby amended and supplemented to the extent that 138-7 shall henceforth read as follows: 138-7. Vehicles used for sport fishing and other recreational purposes. The following regulations shall apply to motor vehicles to be operated on the beaches for sport fishing: A.A person desiring to operate a motor vehicle on the beaches of this City for sport fishing or any other approved recreational purpose shall make application for a license to do so at the Office of the City Clerk during regular business hours only. Said application shall be made on a form prepared by the City Clerk which contains all pertinent provisions, rules and regulations of the Beach Management Plan of the City of North Wildwood. D.Any person obtaining a license under this article, by signing the application for said license, agrees to possess and maintain in good condition all necessary equipment listed in 138-7C in his or her vehicle while it is being operated on the beaches of the City of North Wildwood, and also agrees to be subject to spot inspections by the North Wildwood Police Department while said vehicle is operating on the beaches of the City of North Wildwood. E. F. The City reserves the right to revoke any license issued under this article for any violation of the provisions, rules and/or regulations contained herein. Section Four. The portion of Ordinance 632, as amended, that has been codified in the Code of the City of North Wildwood at 138-11 is hereby amended to the extent that 138-11 shall henceforth read as follows: A.Access to and from the beach shall only be made in accordance with those access points that are approved in the Beach Management Plan of the City of North Wildwood. Said access points will be identified on the form of application prepared by the City Clerk for permission to operate vehicles on the beaches of the City of North Wildwood. B.Vehicles shall only cross the dune system at specified, approved vehicle crossovers. C.The use of pedestrian crossovers by vehicles is prohibited. Section Seven. If any portion of this Ordinance is determined to be invalid by a court of competent jurisdiction, that determination shall have no effect upon the remainder of this Ordinance, which shall remain valid and operable. Section Eight. All Ordinances or parts of Ordinances inconsistent with this Ordinance, to the extent of such inconsistencies only, be and the same hereby are repealed. Section Nine. This Ordinance shall take effect immediately upon final passage and publication as provided by law. It shall be lawful to operate a motor vehicle, licensed under this article, on the beaches of this City, pursuant to the terms of this article, only as follows: A.For the purpose of sport surf fishing and any other recreational purpose deemed appropriate and approved by the Chief of Police or his designee or at the direction of the Director of Public Safety, the dates and times for said purposes shall be in accordance with the Beach Management Plan of the City of North Wildwood. Such dates and times, and all other appertaining provisions, rules and regulations, shall be clearly explained and listed on a form of application prepared by the City Clerk for permission to operate vehicles on the beaches of the City of North Wildwood. Said form of application shall be approved by Resolution of Council, and shall be updated by Resolution of Council at such time as the provisions, rules and regulations of the Citys Beach Management Plan are amended and/or supplemented by a subsequent Beach Management Plan. Said Resolutions and the corresponding updated forms of application shall be placed on file with this Ordinance in the Office of the City Clerk. B.For any other purpose deemed appropriate for commercial vehicles by the Chief of Police of the City of North Wildwood or his designee or at the direction of the Director of Public Safety. C.For the purpose of operating a beach tram, which shall be operated by the City of North Wildwood or an individual or entity under contract with the City of North Wildwood. Section Three. The portion of Ordinance 632, as amended, that has been codified in the Code of the City of North Wildwood at 138-7 is hereby amended and supplemented to the extent that 138-7 shall henceforth read as follows: 138-7. Vehicles used for sport fishing and other recreational purposes. The following regulations shall apply to motor vehicles to be operated on the beaches for sport fishing: A.A person desiring to operate a motor vehicle on the beaches of this City for sport fishing or any other approved recreational purpose shall make application for a license to do so at the Office of the City Clerk during regular business hours only. Said application shall be made on a form prepared by the City Clerk which contains all pertinent provisions, rules and regulations of the Beach Management Plan of the City of North Wildwood. Said form of application shall be updated as necessary from time to time by Resolution of Council. B.The Office of the City Clerk shall collect a fee of $20 for each license issued hereunder. Such license shall be valid according to the dates and times permitted in the Citys Beach Management Plan. Applicants whose application are approved shall receive a descriptive, numbered decal which shall be affixed to any corner of the rear window of the motor vehicle licensed under this article and which shall remain visible at all times. C.The following equipment must be carried in any vehicle using the City of North Wildwood beaches: tow rope, jack with a board, inflated spare tire, shovel, fire extinguisher with necessary material and supplies, first-aid kit and flashlight. D.Any person obtaining a license under this article, by signing the application for said license, agrees to possess and maintain in good condition all necessary equipment listed in 138-7C in his or her vehicle while it is being operated on the beaches of the City of North Wildwood, and also agrees to be subject to spot inspections by the North Wildwood Police Department while said vehicle is operating on the beaches of the City of North Wildwood. E. The fee for extraction of a private vehicle stuck on the beaches of the City of North Wildwood, which extraction requires the attention and assistance of the Department of Public Works, shall be $500. F. The City reserves the right to revoke any license issued under this article for any violation of the provisions, rules and/or regulations contained herein. Section Four. The portion of Ordinance 891 that has been codified in the Code of the City of North Wildwood at 138-8B is hereby amended to the extent that 138-8B shall henceforth read as follows: B.Permits will be issued on a date-to-date basis, and said time period will be determined by the Chief of Police or his designee, at his or her sole discretion. Section Five. The portion of Ordinance 891 that has been codified in the Code of the City of North Wildwood at 138-8 is hereby amended and supplemented to the extent that 138-8 shall henceforth contain a new paragraph, which shall be codified as 138-8E and which shall read as follows: E.The fee for extraction of a private vehicle stuck on the beaches of the City of North Wildwood, which extraction requires the attention and assistance of the Department of Public Works, shall be $500. Section Six. The portion of Ordinance 632, as amended, that has been codified in the Code of the City of North Wildwood at 138-11 is hereby amended to the extent that 138-11 shall henceforth read as follows: A.Access to and from the beach shall only be made in accordance with those access points that are approved in the Beach Management Plan of the City of North Wildwood. Said access points will be identified on the form of application prepared by the City Clerk for permission to operate vehicles on the beaches of the City of North Wildwood. B.Vehicles shall only cross the dune system at specified, approved vehicle crossovers. C.The use of pedestrian crossovers by vehicles is prohibited. Section Seven. If any portion of this Ordinance is determined to be invalid by a court of competent jurisdiction, that determination shall have no effect upon the remainder of this Ordinance, which shall remain valid and operable. Section Eight. All Ordinances or parts of Ordinances inconsistent with this Ordinance, to the extent of such inconsistencies only, be and the same hereby are repealed. Section Nine. This Ordinance shall take effect immediately upon final passage and publication as provided by law.
