Superior Court of New Jersey, Cape May County, Chancery Division Docket No.: CPM-C-32-25 From the State of New Jersey to Andrew Kinka: Michelle Dunn has filed a lawsuit against you in the Superior Court of New Jersey. The Complaint alleges that Andrew Kinka did not comply with his obligations under the terms of the Settlement Agreement; Andrews breaches are material to the Agreement and affect the purpose of the Agreement in a vital way; Andrews representations with regard to the Property value as well as his ability and/ or intention to comply with the terms of the Settlement Agreement were false and misleading; Michelle would not have entered the Settlement Agreement had she known of Andrews misrepresentation in this respect; The Settlement Agreement was therefore based on a fundamental mistake, which was either shared by both parties, or was based on an intentional misrepresentation by Andrew; It would be unjust for Andrew to retain the benefit conferred upon him by Michelle through the Parties jointly borrowed funds, as well as the Settlement Agreement, especially when he has not complied with its terms; Andrew will be unjustly enriched by retaining and selling the Property without repaying the Parties joint $250,000 loan, as well as his share of the payments already made by Michelle; Michelle is a 50% rightful owner of the Property and therefore is entitled to partition of the Property by sale. If you dispute this Complaint, you or your attorney must file a written Answer or Motion (with fee of $135.00 and completed Case Information Statement) if you want the Court to hear your defense. If you do not file and serve a written Answer or Motion within thirty (35) days, the Court may enter a judgment against you for the relief Plaintiff demands, plus interests and costs of suit. If Judgment is entered against you, the Sheriff may seize your money, wages or property to pay all or part of the Judgment. If you cannot afford an attorney, you may call the Legal Services office in the county where you live or the Legal Services of New Jersey Statewide Hotline at 1-888-LSNJ-LAW (1-888-576-5529). Owners Address:4200 Park Boulevard, Wildwood, NJ 08260 Property Description:Block 92, Lots 7, 21 & 22 Property Address: 4408 Park Boulevard, Wildwood, NJ 08260 PLEASE TAKE NOTICE that on September 8, 2025 at 6:00 P.M., at City Hall, 4400 New Jersey Avenue, 2nd floor in the Commissioners Meeting Room, Wildwood, Cape May County, New Jersey, on the appeal or application of the undersigned for a use variance pursuant to N.J.S.A 40:55D-70(d) limited to Lots 21 and 22 and a conditional use variance pursuant to N.J.S.A. 40:55D-70(d)(3), on the premises located at 4408 Park Boulevard, Wildwood, New Jersey 08260, and is designated as Block 92, Lot 7, 21 & 22 on the Tax Map of the City of Wildwood. The section citations and titles of the Wildwood City ordinances for which relief is sought are as follows: The Applicant proposes to redevelop a portion of the property located at Block 92, Lots 7, 21, and 22, to establish a new seasonal bar known as The Open Container Bar. The project includes repurposing an existing shipping container on Lot 7 as a bar, removing the existing loading dock, and converting part of the existing concrete pad into an outdoor seating area. Lots 21 and 22, located directly behind the bar, will be used as shell parking lots to serve the bar use. The Applicant seeks two variances in connection with the proposed development. First, a N.J.S.A 40:55D-70(d) use variance from Wildwood Zoning Ordinance 17-413(E)(2) is requested to permit off-street parking on a separate lot, as Lots 21 and 22 are not approved for parking as a principal use. Additionally, the Applicant seeks a waiver from Section 17-501(B)(5)(c) to eliminate the requirement for landscape screening between the parking lot and adjacent property lines. Applicant also seeks any and all other variances and/or waivers that the Board Engineer may identify in a review memorandum or letter or that may be deemed necessary by the Board at the time of the hearing. Any person affected by this application will have the opportunity to present any objections to the proposed development. However, the Board reserves the right to exclude repetitious testimony.
