CITY OF WILDWOOD Cape May County, New Jersey RESOLUTION RESOLUTION APPROVING THE PURCHASE OF A T595 T4 V2 BOBCAT COMPACT TRACK LOADER WITH ACCESSORIES. WHEREAS, the Department of Public Works (Department) recommends that the City of Wildwood (the City) procure a T595 T4 V2 Bobcat Compact Track Loader with accessories for the City; and WHEREAS, the Department has researched vendors and determined that the sought-after equipment may be procured through a nationally-recognized and accepted cooperative purchasing contract between Sourcewell and Bobcat of Vineland, NJ; and WHEREAS, pursuant to N.J.S.A. 52:34-6.2b.(3) (as amended by P.L. 2011, c.139) and LFN 2012-10, a New Jersey municipality may purchase goods and services without public bidding under the Local Public Contracts Law through the use of a nationally-recognized and accepted cooperative purchasing contract that has been developed utilizing a competitive bidding or contracting process by another contracting unit within New Jersey or another state; and WHEREAS, Sourcewell is a regional organization of governments operating under the laws of the State of Minnesota and is a political subdivision of the State of Minnesota; and WHEREAS, the subject cooperative purchasing contract was awarded by Sourcewell to Bobcat of Vineland utilizing a competitive contracting process; and WHEREAS, also pursuant to N.J.S.A. 52:34-6.2b.(3) (as amended by P.L. 2011, c.139) and LFN 2012-10, prior to making purchases under nationally-recognized and accepted cooperative purchasing contracts, the municipality must determine that the use of the cooperative purchasing contract shall result in cost savings after all factors, including charges for service, material, and delivery, have been considered; and WHEREAS, the Department has determined that the Citys use of the Sourcewell cooperative purchasing contract to procure the aforementioned equipment will result in cost savings to the City; and WHEREAS, consistent with the Sourcewell cooperative purchasing contract and needs of the City, Bobcat of Vineland has submitted a proposal to provide a T595 T4 V2 Bobcat Compact Track Loader with Accessories for the City for the sum of $74,484.28 and WHEREAS, the Chief Financial Officer has certified that sufficient funds are available for this purchase. The Applicant is seeking the following relief: 1.Site plan approval pursuant to the Land Use Development Ordinance of the City of Wildwood as well as the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-46 and N.J.S.A. 40:55D-50; 2.Minor subdivision approval pursuant to the Land Use Development Ordinance of the City of Wildwood as well as the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-47 in order to subdivide the existing Property to create the following: a.A lot that is approximately 2,800 square foot lot to be known as Lot 20; and b.Another lot that is approximately 5,077 square foot lot, with approximately 7,327 square feet when including land and water, to be known as Lot 14; 3.Variance relief from the Land Use Development Ordinance of the City of Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) as follows: a.Lot depth for proposed Lot 14, where 80 feet is required and 42.97 feet is proposed; and b.Lot depth for proposed Lot 20, where 80 feet is required and 70 feet is proposed; 4.Variance relief from the Land Use Development Ordinance of the City of Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(d) as follows: a.D(6) building height variance for either or both proposed structures, if required, based on the redesign of the structure, where the maximum permitted building height is 34 feet above base flood elevation, and the Applicant proposes to construct certain amenities and architectural features which may exceed the permitted height by 10% or more and/or may constitute an additional story, depending on what the Board determines to consider the top of the structure. 5.Any other bulk, dimensional and accessory variance relief or exceptions from the Land Use Development Ordinance of the City of Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) or N.J.S.A. 40:55D-70(d) which may be required, including, but not limited to, number of parking spaces, size of driveways, dimensions of parking spaces, curb cuts, side yard setbacks, front yard setbacks, rear yard setbacks, setbacks to overhangs, distance between structures, accessory building size or setbacks, lot coverage, building coverage, building height, number of stories, landscaping, building fa{c-ced}ade, accessory structures, setbacks to the swimming pools or pool equipment, location of swimming pools, distance between swimming pool and other structures, fencing, lighting, building projections; and 6.The Applicant may also apply for such variance relief, exceptions, waivers, permits, approvals or licenses that are deemed necessary or appropriate by the applicant or the Board, which may arise during the course of the hearing process.
