The Applicant is seeking the following: 1.Site plan approval, if required, pursuant to the Land Use Development Ordinance of the City of North Wildwood as well as the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-46 and N.J.S.A. 40:55D-50; 2.Variance relief from the Land Use Development Ordinance of the City of North Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) as follows: a.Minimum required lot area, where 4,000 square feet is required and 2,658.5 square feet exists, and 2,658.5 square feet (Deeded Area) and 3,037 square feet (Upland Area to Bulkhead) is proposed; b.Minimum required lot depth, where 100 feet is required and 52.06 feet exists, which is a preexisting nonconforming condition and will not change as a result of the proposed project; c.Minimum required side yard setback, where 6 feet is required on each side, 10.56 feet on the East side and 8.14 feet on the West side exists, and 5.11 feet on the East side and 5.33 feet on the West side is proposed; d.Minimum required rear yard setback, where 10 feet is required, 15.04 feet exists, and 0 feet is proposed; e.Maximum permitted impervious coverage, where 80% is permitted, 93% exists and 84% is proposed; f.Minimum required rear yard setback to the swimming pool, where 4 feet is required, 0 feet exists and 0 feet is proposed; g.Minimum required distance between the swimming pool and building, where 8 feet is required, 7.07 feet exists and 5.25 feet is proposed; and h.Design waiver, or variance required, for minimum contiguous raised curb where 50% of the lot width is required to be contiguous raised curb and less than 50% is proposed. 3.Any other bulk, dimensional and accessory variance relief or exceptions from the Land Use Development Ordinance of the City of North Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) which may be required, including, but not limited to, side yard setbacks, front yard setbacks, rear yard setbacks, setbacks to roof overhangs, building height, number of stories, building coverage, lot coverage, distance between structures, accessory structure setbacks, elevation of and distance to HVAC equipment, number, location or dimensions of parking at the Property in conjunction with the Residential Site Improvement Standards and curb cuts; and 4.The Applicant may also apply for such variance relief, exceptions, waivers, permits, approvals or licenses that are deemed necessary or appropriate by the Applicant or the Board, which may arise during the course of the hearing process. BOROUGH OF STONE HARBOR COUNTY OF CAPE MAY STATE OF NEW JERSEY NOTICE OF ORDINANCE INTRODUCTION ORDINANCE NO. 1686 AN ORDINANCE AMENDING CHAPTER 386 (PARKING LOTS, MUNICIPAL) OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF STONE HARBOR TO REVISE PARKING REGULATIONS WHEREAS, the Borough Council of the Borough of Stone Harbor has determined that it is in the best interest of the public to revise regulations governing municipal parking lots to better manage limited parking resources and ensure equitable access; and WHEREAS, the Borough seeks to designate specific parking areas for Borough employees and guests at the Borough Hall Parking Lot and to provide limited free parking for Borough business in front of Borough Hall; and NOW, THEREFORE, BE IT ORDAINED by the Borough Council of the Borough of Stone Harbor, County of Cape May, State of New Jersey, as follows: Section 1. Amendment to 386-2 (Prohibited Hours; Lots Designated). Section 386-2 of the Borough Code is hereby amended to include the following additional municipal parking areas under the list of Borough-operated parking lots, with the following restrictions: A. Northwest corner of 96th Street and 1st Avenue (Borough Hall Parking Lot) Block 95.02, Lot(s) 55 thru 63.01 and Block 95.02, Lot(s) 63.02 & 65 Parking restricted to vehicles with Borough Employee parking permits and Borough Guest permits only between the hours of 7:30 AM through 5:00 PM. East side of 1st Avenue between 96th and 95th Street (in front of Borough Hall) Free ten (10) minute parking for Borough business between the hours of 8:30 AM through 4:00 PM, Monday through Friday. Section 2. Amendment to 386-7 (Parking Permits). Section 386-7 of the Borough Code is hereby amended to read as follows: 386-7. Parking Permits. A. Parking by permit upon the following five parking lots in the Borough is hereby authorized: the two parking lots east of Sunset Drive on the north side of 96th Street (Lots 238 through 245 and Lots 249 through 254 in Block 95.4), the parking lot west of Second Avenue on the south side of 97th Street (Lots 80, 82, 84, 86, 88, 90, and 92.1 in Block 97.3), Second Avenue on the west side between 93rd and 94th Street (Block 93.03, Lots 71 through 78), and the parking lots east of First Avenue between 94th and 96th Streets, commonly referred to as the Beach Lots (Lots 9, 11, 13, 15, 17, 19, 20, 21, and 22 of Block 94.01; and Lots 10, 12, 14, 16, 18, 19, 20, 21, 22, 23, 24, 25, and 26 of Block 95.01), except as it may apply to the northwest corner of 96th Street and 1st Avenue, commonly known as the Borough Hall Parking Lot (Block 95.02, Lot(s) 55 thru 63.01 and Block 95.02, Lot(s) 63.02 & 65), whereby parking will be restricted between the hours of 7:30 AM through 5:00 PM to vehicles with Borough Employee parking permits and/or Borough Guest permits only, and the east side of 1st Avenue between 96th and 95th Street in front of Borough Hall, which shall provide free ten (10) minute parking for Borough business between the hours of 8:30 AM through 4:00 PM, Monday through Friday.
